Did You Know? There is a reason criminal defense attorneys knowingly defend guilty clients
Every great once in a while I get asked: “How do you defend guilty clients if you know they’re guilty?” My response? Without hesitation. Criminal defense attorneys are the core guardians of our constitution. Almost everything in the Bill of Rights applies when someone is charged with a crime. And the Constitution protects everyone, including guilty criminals. If you think about it—our Consitution itself was written by British “criminals.”
So what about those guilty clients who get off scot free? What about those who get less than they deserve? Those cases are quite rare, and the law itself requires attorneys to zealously represent their clients and maintain confidentiality. Allowing attorneys to back out of the case would be a giveaway. A maxim taught in the English and American legal systems is the “Blackstone Ratio.” It states: “It is better for ten guilty people to go free than one innnocent man to be convicted.” In other words, the rights of the innocent should be valued above all else. The rare guilty getting off the hook is a small price to pay.
