One of the most commons questions I get in custody cases is this: At what age can my children pick me as the custodial parent? The answer is the kids can never pick their parent, but many 16 and 17 year olds can almost do so. When judges make custody decisions they have to have two things: (1) has there been enough proof of a material change in circumstances since the last custody order and if so, (2) what is in the best interests of the minor?
